You mention Perez Hilton, actually he has being sued tons of times and he settles most of the times but their are currently active multi-million dollar lawsuits pending against him. If you have access to Westlaw or Nexis do a search for Mario Lavandeira which is his real name.

Living in the US we are open to get sued at any time can these suits prosper is another thing.

There is nothing in the Online Casino Ban law that states a person can not be sponsored by an online casino especially when you take into consideration Poker is an international sport. The problem with online casinos is in the acceptance of bets from a US player. This is an ongoing legal issue and I will not even go there all I can tell you Stan until this shit is straighten out I will stay as far as fuck as I can from using casino affiliates. I have made good money from poker stuff from ClickBank though.

Blogger TOS is really weak an open to exploit with mass blog generation Squidoo has no legal ground to prohibit anybody linking to there web site. They have not done much about it either because they make money too.

Stan my best advice to you. Stay as far as possible from anything that can be used by a Terrorist for any reasons let it be a proxy or something that can be used for money laundering like online casinos.

Second if you feel uncomfortable about something do not do it. Their are many ways of making money online with out going to jail.

		<description>Good stuff Vic.  Sorry in advance for the long post but every time I post about this issue I get zero replies and you seem to be able to shed some light.  I do realize your post was talking about an extreme BH issue and does not relate to much of what I'll be discussing.  I use a few examples from your posts but they are only there to help me understand this issue better.  In no way am I trying to bash or attack you.  I understand if this post is to long for the comments but I would love to discuss this with you via email or skype sometime.

I've tried to research the liability I take on as an affiliate but don't know where to look and haven't found any cases of small time affiliates getting sued. (I know Azoogle paid out $1 mil to FL over some ringtone case and some other network had something similar)  My original concern was a person or company coming back at the affiliate for promoting a product that caused the person to get hurt, lose money, etc.   It would seem the merchant would be at fault since its their product and as an affiliate you are just acting as a salesman.  But if you live in the US; people can sue for anything and I would think it would be easier to sue an affiliate than going after a company that has cash and lawyers to hide behind.  Whats your thoughts on the liability an affiliate marketer has assuming they are playing by common sense rules?  (Although technically we would each have to hire a lawyer specializing in internet law since there is no rule book out there)

Some things I think about:

-The internet is constantly changing so laws can not keep up plus its all but impossible to prove guilt online. (Obv not in all cases)  If you get sued for something online how can a court prove you actually did it?  I don't see how records by online providers can be useful since anyone can hack you, change their ip to yours, mis use your unique affiliate id to set you up, send emails from your account, the list  goes on.  Like an online identity theft of your affiliate business account.  

-Why aren't there a million copy right, libel, defamation of character suits going on?   Perez Hilton Com makes tons of cash from his site and I doubt he pays for every photo he puts up there.  

-How does clicking accept on a TOS agreement bind you legally?  You can print out the TOS but who's to say you didn't modify it or the site didn't.  Its not a document you have to sign.

-In the BH case you talked about a common person can see that its illegal but where do we go to check up on other things we read.  You mention making thousands of blogger blogs to link to squidoo pages.  I not sure but I would think this is against blogger's TOS and proablly Squidoos too. 

-In your online casino example; how are all the big time pros allowed to be sponsored by these illegal sites and live in the US?  They are on the sites every night, talk about it in their blogs and interviews and promote them at all times.  Cardplayer Com has tons of online poker affiliate links, you would think they would be shut down too. X governor jesse ventura promotes an online sports book.   

-Somehow Google, Yahoo, MSN can have an image search because they only post small photos.  Try shrinking copyrighted  photos in the brick and motar world and see what happens.  Youtube hosts millions of copyrighted videos.  Its bull shit, copy right holders have to manually request things be taken down since Youtube is protected by whatever law says they aren't responsible for user content.
