I've tried to research the liability I take on as an affiliate but don't know where to look and haven't found any cases of small time affiliates getting sued. (I know Azoogle paid out $1 mil to FL over some ringtone case and some other network had something similar) My original concern was a person or company coming back at the affiliate for promoting a product that caused the person to get hurt, lose money, etc. It would seem the merchant would be at fault since its their product and as an affiliate you are just acting as a salesman. But if you live in the US; people can sue for anything and I would think it would be easier to sue an affiliate than going after a company that has cash and lawyers to hide behind. Whats your thoughts on the liability an affiliate marketer has assuming they are playing by common sense rules?
